SeeStep Terms and Conditions

1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” “User”) and DOCH Holdings Pty Ltd (“SeeStep,” “we,” “us,” “our”) governing your use of the SeeStep mobile application and all related services (collectively, the “Service”).
By downloading, installing, or using SeeStep, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
SeeStep is a mobile application that helps parents and caregivers of neurodivergent children create personalized visual support materials. The Service includes:
- Plan — AI-generated visual schedules to help structure the day
- Storybook — personalized social stories to help children understand and prepare for experiences
- How-To Guide — step-by-step visual guides for learning new skills
- Checklist — personalized checklists for any activity or event
- Choice Board — visual choice boards and First-Then boards to support decision-making
3. Eligibility
3.1 Age Requirement
You must be at least 18 years of age to create an account. The Service is designed for use by parents and caregivers, not directly by children.
3.2 Child Mode
SeeStep includes a supervised “child mode” that allows children to interact with previously created materials under parental oversight. Child mode does not create accounts, collect personal information from children, or transmit child interactions to external services.
3.3 Parental Responsibility
By using the Service, you represent and warrant that you are the parent or legal guardian of the child whose information you enter, and you accept responsibility for all use of the Service under your account.
4. Account Registration and Security
To use the Service, you must create an account using a valid email address. We use passwordless authentication — you will receive a one-time passcode (OTP) to your email each time you sign in.
You are responsible for maintaining the security of your email account and all activity that occurs under your account.
5. Subscriptions and Payment
5.1 Subscription Tiers
SeeStep may offer multiple subscription tiers (e.g., individual, family, professional), each with different AI generation quotas. Details are displayed within the app.
5.2 Billing
Subscriptions are billed through the Apple App Store or Google Play Store. All billing, payment processing, and refunds are handled by the respective platform.
5.3 Automatic Renewal
Subscriptions automatically renew unless you cancel before the renewal date through your device's app store settings.
5.4 Usage Quotas
Each tier includes a monthly AI generation quota. Previously created materials remain accessible regardless of quota status.
6. Acceptable Use
You may use the Service for its intended purpose: creating visual support materials for children in your care. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Reverse engineer, decompile, or disassemble the Service
- Interfere with or disrupt the Service
- Use automated means to access the Service
- Use the Service to generate harmful, abusive, or inappropriate content
- Share your account credentials
7. Intellectual Property
7.1 Our Intellectual Property
The Service is owned by DOCH Holdings Pty Ltd and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes.
7.2 Your Content
You retain ownership of content you create and upload. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
7.3 AI-Generated Content
Generated materials are for your personal use. You may use, print, and share them with caregivers, educators, and therapists. You may not resell AI-generated content or use it for commercial purposes.
8. Artificial Intelligence Disclaimer
Visual support materials are created using artificial intelligence. While we design our AI prompts to produce neurodiversity-affirming, age-appropriate content, AI-generated output:
- May occasionally contain errors or inaccuracies
- Should be reviewed by a parent or caregiver before use with a child
- Does not constitute medical, therapeutic, psychological, or educational advice
- Should not replace guidance from qualified professionals
SeeStep is a planning and organization tool, not a medical device, therapeutic tool, or diagnostic instrument.
9. Child Mode and Supervised Use
Child mode is designed for supervised use. Parents are responsible for supervising their child's use of the app and configuring appropriate feature access through child mode settings.
Interactions in child mode (e.g., marking activities as complete) are stored only on the local device and are not transmitted to our servers.
10. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service relies on third-party AI services whose availability is outside our control.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SEESTEP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless SeeStep from claims arising from your use of the Service, violation of these Terms, or use of AI-generated content with children.
14. Termination
You may stop using the Service and request account deletion at any time by contacting info@seestep.app. We may suspend or terminate your access if you violate these Terms.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia. Subject to Section 16, disputes shall be resolved through binding arbitration in Brisbane, Queensland.
16. Consumer Protection and Statutory Rights
Nothing in these Terms — including the arbitration clause in Section 15 — limits or excludes any rights you have as a consumer under the mandatory laws of your jurisdiction. In particular:
- United Kingdom: These Terms do not affect your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation. UK consumers may bring claims before UK courts and are not bound by the arbitration clause to the extent it would constitute an unfair contract term.
- United States (California): California residents retain all rights under the California Consumer Legal Remedies Act and applicable state consumer protection law, including the right to bring claims in California courts for amounts within small claims jurisdiction.
- Canada: Canadian consumers retain all rights under applicable federal and provincial consumer protection legislation. The arbitration clause does not prevent you from filing a complaint with relevant Canadian regulators including the Privacy Commissioner of Canada.
- New Zealand: These Terms do not limit your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- All jurisdictions: You may always file a complaint with your local data protection or consumer protection authority regardless of this arbitration clause.
17. Platform Terms
If you downloaded SeeStep from the Apple App Store, you acknowledge that these Terms are between you and SeeStep, not Apple. If downloaded from Google Play, your use is also subject to Google Play's Terms of Service.
